Local Government Comprehensive Plans - HB 359/ SB 540

Currently, when a local government makes a bad change to a Comprehensive Plan (usually to allow more development), citizens can file a lawsuit to challenge that decision. Generally, at the conclusion of these lawsuits, each side pays for their own attorney. 

HB 359/ SB 540 entitled "Local Government Comprehensive Plans" would allow the winning parties to recover their attorney fees from the losing parties in legal challenges to comprehensive plans and plan amendments. As you can imagine, developers' attorneys are usually very expensive. This would effectively eliminate planning challenges by citizens and public interest groups because, if they lose, they could be required to pay enormous legal costs incurred by deep-pocketed developers and local governments.

Bottom Line: This bill will make it prohibitively expensive for citizens to challenge irresponsible development decisions in court.
